Terms of Service

By creating an account or using CookedBanana ("Service", "we", "us"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

The Service is operated by Fabio Ariotti (sole trader), Via Vercelli 18, 13039 Trino (VC), Italy — P.IVA IT02782390021 — C.F. RTTFBA97T03B885G — REA VC-312122.

CookedBanana is an AI-powered tool that generates detailed text prompts for use with image generation models ("Nano Banana Model" and compatible systems). Users can submit photographs or written descriptions as inputs to obtain structured, AI-generated prompt outputs.

The Service is intended for creative, professional, and commercial use in photography, fashion, and digital art production.

• You must be at least 16 years old to create an account. By registering, you confirm that you meet this requirement.
• You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential.
• You are responsible for all activity that occurs under your account. Notify us immediately at FabioAriotti@CookedBanana.Com if you suspect unauthorized use.
• One account per person. Creating multiple accounts to circumvent credit limits or restrictions is prohibited.

The Service operates on a credit-based system. Each generation consumes one credit. Credits are allocated monthly based on your subscription plan:

• Free – limited credits upon registration, not renewed monthly.
• Starter, Pro, Agency – paid monthly or yearly subscriptions with renewable credits as described on the pricing page.

Payments are processed by Stripe. By subscribing, you authorize recurring charges to your payment method. Subscriptions auto-renew unless canceled before the renewal date.

Credits are non-transferable, non-refundable, and expire at the end of each billing cycle unless otherwise stated. Unused credits do not carry over between cycles.

We reserve the right to change pricing with at least 30 days' notice to active subscribers via email.

Due to the digital and immediately consumable nature of the Service, payments for subscription plans are generally non-refundable once credits have been used.

If you experience a technical issue that prevents you from using credits you have paid for, contact us at FabioAriotti@CookedBanana.Com within 14 days and we will evaluate the case on an individual basis.

Consumers in the EU have a statutory 14-day right of withdrawal from the date of purchase, provided no credits have been consumed. To exercise this right, contact us within that period.

You agree NOT to use the Service to:

• Generate content that is illegal, hateful, violent, sexually explicit, or that violates the rights of any third party.
• Upload images depicting real persons without their consent, or images that infringe any copyright, trademark, or privacy right.
• Attempt to reverse-engineer, scrape, or abuse the AI models or APIs underlying the Service.
• Use automated scripts, bots, or other means to access the Service beyond what is permitted by your plan.
• Circumvent security measures, authentication, or rate limits.

We reserve the right to suspend or terminate accounts that violate these rules, without refund.

Your inputs: You retain all ownership rights over the images and text you submit. By using the Service, you grant us a limited, non-exclusive license to process your inputs solely to provide the Service.

AI-generated outputs: The prompt outputs generated by the Service are provided to you for your personal and commercial use. We claim no ownership over them. However, we cannot guarantee their uniqueness; similar inputs may produce similar outputs for other users.

Our platform: All trademarks, logos, software, and content belonging to CookedBanana remain our exclusive property. You may not copy, reproduce, or redistribute them without prior written permission.

Outputs are generated by AI models (Google Gemini) and are provided "as is". We do not guarantee the accuracy, suitability, or completeness of any generated prompt. You are solely responsible for how you use the outputs.

AI-generated content may occasionally produce unexpected, inaccurate, or incomplete results. We are not liable for any decisions made based on AI outputs.

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including failures of third-party providers such as Supabase, Stripe, or Google).

We reserve the right to modify or discontinue any feature of the Service with reasonable notice.

To the maximum extent permitted by applicable law, CookedBanana and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or loss of business opportunities.

Our total aggregate liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

You may delete your account at any time from Settings → Delete account. Upon deletion, all your data will be permanently erased within 30 days, subject to legal retention obligations.

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law.

These Terms are governed by and construed in accordance with Italian law. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Vercelli, Italy.

If you are a consumer resident in the EU, you may also have access to the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may update these Terms at any time. We will notify active users by email at least 15 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
